Stand:
Privacy policy
Here you can find out which personal data is processed when you visit this website, and why.
1. Controller
2. No cookies, no tracking
We do not use cookies or any analytics or advertising tracking services. Only your language choice (German/English) is stored in your browser (so-called local storage) so that the site appears in your language on your next visit. This information does not leave your device.
3. Hosting and server log files
This website is hosted by Netlify, Inc. (San Francisco, USA). When you open the site, the hosting provider processes technically necessary data, in particular your IP address, the date and time of the request, the page requested and information about your browser. This is required to deliver and secure the website. The legal basis is our legitimate interest in a secure and efficient operation (Art. 6(1)(f) GDPR). Where data is processed outside the EU/EEA, the transfer may rely on standard contractual clauses or an adequacy decision.
4. Contact form and enquiries
If you contact us via the “Start a project” form, we process the data you enter: name, email address, optionally company, your area of interest, budget range, your message and the language of the website. In addition, technical data that arises when the form is submitted (e.g. IP address) is transmitted.
To transmit the form we use the form service Web3Forms (web3forms.com). Your entries are forwarded through its servers to our email inbox; the servers may be located outside the EU/EEA. Information about the provider’s data processing is available at web3forms.com.
The purpose is to process your enquiry and to get in touch with you. The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures at your request) and otherwise our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). If no order results, we keep your details for 12 months at most and delete them afterwards, unless statutory retention obligations apply; if an order results, section 8 applies. The fields marked with * are required so that we can reply; without them we cannot process your enquiry.
5. Contact by email or phone
If you contact us by email, phone or direct message (e.g. Instagram, Facebook), we process your details (e.g. name, contact details, content of the message) to deal with your request. The legal basis is Art. 6(1)(b) or (f) GDPR. We delete the data as soon as it is no longer required and no statutory retention obligations apply.
6. External services loaded with the page
When you open this page, your browser loads content from the following external servers. In each case your IP address is transmitted to the respective provider:
- Google Fonts (fonts.googleapis.com, fonts.gstatic.com; Google Ireland Limited, Dublin, Ireland, or Google LLC, USA) for the site’s typeface.
- Tailwind CSS (cdn.tailwindcss.com) for the site’s styling code.
- Unsplash (images.unsplash.com) for some placeholder images.
The legal basis is our legitimate interest in an attractive and functional presentation of the website (Art. 6(1)(f) GDPR).
7. Links to Instagram, Facebook and YouTube
The website only contains links to our profiles on Instagram, Facebook and YouTube. No content from these services is embedded, and no data is sent to them when you open our page. Only when you click a link do you leave our website; the privacy notices of the respective provider then apply.
8. Client orders, invoices and recordings for clients
If you commission us, we process the data required for this:
- Order handling: name, address, company, contact details, schedule, briefing. Legal basis: Art. 6(1)(b) GDPR (contract). Retention: duration of the contract plus the warranty period.
- Invoices and accounting: invoice data, payment data, VAT number. Legal basis: Art. 6(1)(c) GDPR (legal obligation). Retention: 10 years (Art. 16 Code de commerce).
- Photo and video recordings for the client: image and sound recordings of people. Legal basis: Art. 6(1)(b) or (f) GDPR, see section 9. Retention: final products 6 months, raw data 3 months after delivery.
- Portfolio and self-promotion: selected recordings. Legal basis: Art. 6(1)(a) GDPR (consent). Retention: until withdrawn.
9. Photo and video recordings of people
- For commissioned productions (e.g. company, portrait, wedding), recording takes place to perform the contract with the client.
- At events, AJmotion films and photographs on behalf of the organiser, based on the organiser’s legitimate interest in documentation. The organiser informs guests in advance (e.g. on the invitation or by a notice sign). Anyone who does not wish to be recorded can contact AJmotion on site at any time.
- For AJmotion’s own portfolio, website and social media, we obtain explicit consent. It can be withdrawn at any time with effect for the future; materials that have already been printed are excluded.
- Recordings of children under 16 are only used for self-promotion with the consent of their legal guardians.
- If recordings are handed over to business clients, the client is itself responsible under data protection law for their further use.
10. Social media profiles
AJmotion runs profiles on Instagram and Facebook; the provider is Meta Platforms Ireland Ltd., Dublin. For the page statistics (Insights), AJmotion and Meta are joint controllers (Art. 26 GDPR); Meta assumes primary responsibility for users’ rights. If you contact us by direct message, we process the message in order to reply. Details can be found in Meta’s privacy policy. We also run a YouTube channel; YouTube/Google’s privacy notices apply there.
11. Recipients and service providers
Data is only passed on where necessary, to:
- cloud storage and gallery services for delivering the files
- subcontractors in production (e.g. second shooter, editor), who are contractually bound to confidentiality
- tax advisers or accounting and the bank
- authorities, where there is a legal obligation
Data processing agreements under Art. 28 GDPR are in place with service providers that process data on our behalf. For providers outside the EU, the transfer is based on an adequacy decision or standard contractual clauses.
12. Security
AJmotion protects data through encrypted storage media, password-protected galleries, two-factor authentication for cloud services and dual data backup. No automated decision-making or profiling takes place.
13. Your rights
Under the GDPR you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing (Art. 21). You can withdraw any consent you have given at any time with effect for the future. An email to the address above is sufficient; we reply within one month.
You also have the right to lodge a complaint with a data protection supervisory authority. In Luxembourg this is the Commission nationale pour la protection des données (CNPD); you may also contact the authority where you live.
14. Changes
We will update this policy if the website, our services or the legal requirements change. The version currently published on aj-motion.com applies.
